PeerTelecom provides an online communication product comprised of software (herein referred to as Software) and manages the operation of a networked telecommunication services (herein referred to as Services).
This privacy policy is provided to define and aid your understanding of how PeerTelecom uses and safeguards the personal and private information that you provide when using PeerTelecom Software and Services.
Within this privacy policy the terms, commitments and policies that relate to the use of PeerTelecom Software and Services are applicable to PeerTelecom its subsidiaries.
The Software is provided to all users for free but some Services may require registration and paid subscriptions in order for some services to be accessed and function.
From the website and through the Software and Service you are able to register to become a user of PeerTelecom and via the Software you will able to communicate with other users of the Software via vocal and textual communication. As part of using the Software you are able to create a personal profile which can be shared with other users of the Software. The software contains a search feature by which you can find others to add them to your contact list and other users may add you to their contact list. In our commitment to provide the highest level of service PeerTelecom may add services which improve, modify or extend the functionality of the Service.
PeerTelecom does not sell, rent, loan, trade, lease or otherwise transfer any personal information collected through PeerTelecom software or service to any third party. PeerTelecom, however, may engage a third party in order to carry out communication and/or marketing, strictly on PeerTelecom's behalf and under PeerTelecom's responsibility. PeerTelecom will treat any information you provide to PeerTelecom as confidential information and will not disclose it to any third party. PeerTelecom will provide information collected through the service to other users in service only with your explicit permission as granted by you through applicable settings available in the Software. This information is generally not stored by PeerTelecom at all and is instead voluntarily shared by users to and from other users in the Service.
While registering, accessing and using PeerTelecom you will provide three types of information to PeerTelecom:
In the process of registering you will provide personal information is required to allow the use of the PeerTelecom Service, this information will include but is not limited to your username, password and billing information. This information will be centrally stored on servers either in France or in the United Kingdom. Billing information is only required if you choose to purchase a particular Service from PeerTelecom. Billing details are stored to be able to comply with local regulations and to be able to provide you with a billing history and greater customer service.
In order that PeerTelecom can be able to improve and increase its level of Service it may seek you feedback through email or online surveys. Your feedback and survey responses would be used by PeerTelecom to enhance and deliver new and improved software and service delivery and provide a more meaningful experience for its users. PeerTelecom may enlist a third party to solicit feedback or to execute a survey on behalf of PeerTelecom from its users. PeerTelecom may also use the information to alert you to offers and products of PeerTelecom in which you have expressed an interest.
Profile information may be required by certain PeerTelecom Services in order for the Software to function as intended and, if so desired, for other users of the Software to communicate with you. Profile Information includes any additional information you enter into the software which describes you (such as name and email address, age range, or gender) and will include your current online status and your IP address which will make it possible for other users to see, which is common to online communications software. Profile Information is not stored centrally but is temporarily transmitted to other users within the Service only if you have chosen to make this information available.
Operational Information which is provided by the Software automatically to PeerTelecom while you use the software is limited to information that is necessary in order to provide you with the desired functionality of the Software and may include a session ID token (Cookie), source and destination addressing information, and the version of the Software you are using. Passive Information is automatically generated and is not stored centrally, except for anonymously aggregated statistical information used to provide you with better service or statistical information used for licensing control purposes.
PeerTelecom does not collect any contents of communications such as calls, voicemail, instant messages or any other form or communication passed through the Software.
No information concerning your computing system/network is collected that is not related to providing PeerTelecom Services, including other installed software systems, non-service-related content, or hardware peripherals.
PeerTelecom will not sell, rent, lease or otherwise provide Personal Information to any third party – with the exception of a third party it has hired to carry out its communications and/or marketing, as set forth above – unless required by the for Services with which you've registered and given permission.
While using the Software, disk space, bandwidth and processing power will be utilised to by PeerTelecom to allow you to communicate with other PeerTelecom users. The Software and Service has been designed to minimise interface with the normal operations of your computer.
PeerTelecom uses advanced security technology to protect the data on your computer, any information you provide to us, and to protect the use of your computer resources. The data contained in your public profile is protected and can only be shared to other users if you chose to make such information public in the software settings. Operational Information you provide is stored temporarily on PeerTelecom's secure databases and only in anonymous aggregate form unless required to provide billing information to Subscribers or to verify the integrity of your identity by Software or to comply with local laws or regulations. Your computer resources cannot be accessed by any third party through the Software.
Software is installed on computers with an installer downloaded from www.peertelecom.com or in combination with other software or web sites. You can uninstall the Software from the standard system Control Panel at any time.
The Software contains an update facility. This enables the Software to determine that there is a newer version available, which has improved or new functionality and/or bug fixes. Your permission will be requested before an update is performed unless you have specifically authorised PeerTelecom to automatically update the Software without notification. The Software may however update non-program files from time to time without asking you. These updates are only used to update file indices, configurations and other non-critical objects. These updates only pertain to executable files.
No part of the Software is directed to children. We will never knowingly collect information from users under the age of 13.
Unless you request that we delete any of the Information you submitted to PeerTelecom, we will be stored for a period of two years or for the period of time required in applicable laws and regulations, whichever is greatest. At the conclusion of that time, all such Information will be deleted.
Upon your request, we will deactivate your account and delete all your personally identifiable information from our databases as soon as reasonably possible provided we are under no obligation to retain this information in response to a criminal investigation as described in the previous section. Send your deactivation requests to delete@peertelecom.com. We will confirm receipt of your request and before deactivating your account will verify that you sent the request.
In the event that PeerTelecom and/or its units or subsidiaries are ever sold, acquired, merged, liquidated, reorganized, or otherwise transferred, reserves the right to transfer its user databases together with any personally identifiable information contained therein, to a third-party acquiring assets. In the event PeerTelecom does so, it will place a prominent notice of the sale on the homepage of its corporate website, with links to information as to how you can change your privacy preferences.
In response to a verified request by a law enforcement or government agency relating to a criminal investigation or alleged illegal activity, we can disclose your email address and usage patterns without a subpoena if we believe in good faith that the disclosure of this information is necessary to prevent imminent physical or mental harm, or financial loss. We will not disclose your personal information to law enforcement or other government agencies for any other reason in the absence of a subpoena or court order.
Please be careful and responsible whenever you're online. If you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return. While we strive to protect your personal Information, PeerTelecom cannot ensure or warrant the security of any Information you transmit to us except for information specifically covered by PeerTelecom End User License Agreement or Privacy Policy. The use of Software and Services is done at your own risk.
